Turkish law specified the conditions and controls related to allowing foreigners in accordance with the legal amendments established to own real estate in Turkey, where the legislator obligated foreign natural persons to ensure the achievement of the public interest. Undoubtedly, the process of implementing the law and applying its provisions requires granting the competent executive authorities certain powers to ensure that these controls are not violated. Especially those related to the conditions of the real estate space that a foreigner is allowed to own, the scope of sites available to him, and other controls.
Where the competent executive authorities have the authority to check the verification of the aforementioned controls. If it is proven to them that violations were committed in the process of real estate ownership in violation of the law, or that the foreign owner used his real estate in a manner contrary to the purposes specified in the law, or that he did not fulfill the obligations imposed on him after owning the property within the times set for that, then The competent executive authorities take decisions requiring the foreign owner to liquidate his real estate within a period of one year from the issuance of the decision.
Accordingly, the foreigner must follow the fundamental legal controls in the process of acquiring real estate in Turkey, and implement the post-purchase requirements. Otherwise, the prescribed legal measures will be taken against him.– Head Quarter Legal Counsel
